2. General terms and conditions of use of the site and the services offered.

Use of the site implies full and complete acceptance of the general terms and conditions of use stipulated below. These terms and conditions of use may be amended or supplemented at any time; users of the site are therefore advised to read them regularly.

This website is normally accessible by users at all times. www.eneor.commay however decide to interrupt the service for technical maintenance reasons, in which case it will endeavour to provide users with advance warning of the dates and times of such maintenance work.

The site is updated regularly by Vincent Le guilvout. Similarly, this legal notice may be amended at any time; as its terms apply to users, they are advised to read it as often as possible in order to keep themselves properly informed.

The purpose of the site is to provide information concerning all the company’s activities.

ENEOR endeavours to ensure that the site contains information that is as accurate as possible. However, it shall not be liable for omissions, inaccuracies or defects in updates, whether through its own fault or that of any third-party partners providing this information.

All information featured on the site is provided for information purposes only and is subject to change. Furthermore, the information featured on the site is not exhaustive. It is provided subject to amendments having been made since its online publication

4. Contractual limitations in relation to technical data.

The internet site shall not be liable for material damage related to the use of this site. Moreover, users of the site undertake to access the site using up to date hardware which does not contain viruses and which possesses an updated version of the latest generation browser

5. Intellectual property and counterfeits.

ENEOR owns the intellectual property rights or holds the usage rights to all the elements that can be accessed on the site, in particular text, images, designs, logos, icons, sounds, software.

All reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited, unless authorised in advance in writing by: ENEOR.

Any unauthorised use of the site or any of the elements contained on it shall be deemed to constitute a counterfeiting offence and shall be prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitations of liability.

ENEOR shall not be liable for direct or indirect damage caused to the property of users when accessing the ENEOR site, resulting either from using hardware that does not comply with the specifications stated in Item 4 herein, or due to a bug or incompatibility.

Likewise, ENEOR shall not be liable for indirect damage (e.g. loss of business or loss of opportunity) arising from use of the site

Interactive areas (which allow questions to be asked in the contact area) are available to users. ENEOR reserves the right to remove, without prior warning, any content placed in this area which might contravene the laws applicable in France, in particular provisions relating to data protection. If necessary, ENEOR also reserves the right to hold the user civilly and/or criminally liable, particularly in relation to messages of a racist, offensive, libellous or pornographic nature, regardless of the medium employed (text, photo, etc.).

7. Personal data management.

In France, personal data is protected in particular by Act no. 78-87 of 6 January 1978, Act no. 2004-801 of 6 August 2004, Article L. 226-13 of the French Penal Code and the European Directive of 24 October 1995.

When using the site, the following information may be collected: the URL of links through which the user accessed the site, the user’s service provider and their internet protocol (IP) address.

In any event, ENEOR does not collect personal information about the user except as required for certain services offered by the site The user provides this information knowingly, in particular when entering it themselves. It is then specified to the user of the site www.eneor.comwhether or not they are obliged to provide this information.

In accordance with Articles 38 et seq. of Data Protection Act 78-17 of 6 January 1978, all users have the right to access, amend and challenge personal data concerning them by sending a signed written request accompanied by a copy of their identity document signed by the document holder, indicating the address to which the reply should be sent.

No personal information about users of the site is published, exchanged, transferred or sold via any medium whatsoever to third parties without the user’s knowledge. This information could only be disclosed in the event that ENEOR and its rights were acquired, in which case it would be disclosed to the buyer, who would be bound by the same obligation as regards storing and modifying data relating to users of the site

The site has not been declared to the CNIL (French Data Protection Authority) as it does not collect personal data.

Databases are protected by the provisions of the Act of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.

8. Hypertext links and cookies.

The site contains a certain number of hypertext links to other sites, set up with the permission of ENEOR. However, ENEOR is not able to verify the content of sites that are visited using these links, and shall not therefore be liable for any consequences resulting from these links.
